AGREEMENT BETWEEN THE EUROPEAN ASSOCIATION FOR BODY-PSYCHOTHERAPY, HEREAFTER CALLED ‘EABP’, AND THE NATIONAL ASSOCIATION OF THE EABP, TITLED:

HEREAFTER CALLED ‘THE NA’.
PREAMBLE: This agreement is designed to identify collaborative issues and procedures in the relationship between the NA and EABP.
It is herein agreed that:
1.1 The NA will act for EABP in that particular country. The NA will support the aims and goals of EABP and will promote body psychotherapy in that country, in the following ways and subject to the following conditions, as from the date of signing of this agreement.
1.2 EABP will support the aims and goals of the NA and the development of body psychotherapy in that country, in the following ways and subject to the following conditions, as from the date of signing of this agreement.
1.3 The NA will be a voting member of the EABP COUNCIL of National Associations and National Committees, hereafter called ‘the COUNCIL’. The NA will be represented at the annual meetings of the COUNCIL, will participate in common activities and conform to agreed COUNCIL regulations and procedures.
It is herein agreed that:
2.1 The NA agrees to assess all the applications from people and organizations in that country for the different types of EABP Membership (e.g. full member, candidate member, associate member, organizational member, etc.), on behalf of EABP and according to the EABP Membership Criteria, using the standard forms and procedures developed by EABP and in cooperation with the Membership Secretary.
2.2 The EABP Membership Secretary retains overall responsibility for all EABP Membership applications and will monitor these. The persons or committee assessing applications on behalf of EABP and the NA in a particular country may be instructed by the EABP Membership Secretary to make appropriate changes in their criteria and procedures to conform to EABP requirements.
2.3 In accepting a suitably qualified and experienced person or organization as a member of EABP, that person or organization is automatically offered the appropriately corresponding membership in the NA.
2.4 If a person or organization in that country does not wish to have their application for EABP membership processed through the NA, or does not wish to be a member of the NA and can state valid reasons for this, they may put their case to the EABP Membership Secretary. If s/he views their case favourably and subject to ratification by the Executive Board of EABP, that person or
organization may become a member of EABP independently of the NA.
2.5 The EABP Membership Secretary can be consulted in the case of any difficulties or complications with an application and, if these cannot be resolved satisfactorily, the application must be referred to an EABP International Membership Committee, constituted from COUNCIL members. The decision of this Committee shall be binding.
2.6 The NA will inform the EABP Secretariat, on a regular base, about all up-to-date changes in data held about the members in that country in the way and when requested by the Membership Secretary and the EABP Secretariat.
3. FEES AND FINANCES
It is herein agreed that:
3.1 The NA will collect all the EABP Membership fees in that country, on behalf of EABP, and forward a proportion of these fees to the EABP Treasurer in the way and when s/he specifies. The EABP Treasurer has the right to question any item in that accounting.
3.2 The EABP General Assembly sets the amount of the EABP Membership fees. An NA in a particular country may request for a variation in these fees due to significantly different economic or professional conditions. The NA should send a written application to the EABP Board and to the COUNCIL Chairperson, giving their reasons for such a variation. The specific agreement of both the EABP Board and the COUNCIL must be obtained. This special case will be reviewed regularly.
3.3 The EABP Board, after consultation with the COUNCIL, will propose the proportion of the EABP Membership fees that can be retained by the NA in a motion to the EABP General
Assembly.
3.4 An abstract of the accounts of the NA, clearly showing funds held at the start of the accounting period, income sources and amounts, main categories of expenditure and amounts, and funds held at the end of the accounting period, will be sent to the COUNCIL’s chairperson and the EABP Secretariat prior to the annual COUNCIL Meeting.
4. NATIONAL ASSOCIATION ACTIVITIES
It is herein agreed that:
4.1 The NA may raise additional funds for itself independently of EABP; it may organize workshops, symposia and congresses, engage in scientific research and perform other actions to fulfill its aims. In so doing, it agrees to act in accordance with the political, professional and ethical position of EABP, and with the aims of EABP.
4.2 EABP will support the activities of the NA, and the recognition and legitimization of body psychotherapy in that particular country.
4.3 The NA may make a request for help and support to the EABP Board and/or the COUNCIL for specific purposes in line with the aims of EABP.
4.4 The NA agrees to promote the biannual EABP Congress and not to hold its own main national congress or symposium in the same calendar year as the EABP Congress; Board.
4.5 The NA agrees to promote all other EABP events and material, with material being suitably translated at the discretion of the NA. The NA can advertise, free of any charges, its own events on the EABP website and with suitable links to its own website or email addresses.
4.6 The NA may translate EABP Application forms, the EABP Introductory Booklet, Membership and FORUM Booklets, the EABP Membership Declaration, and any other EABP published material relevant for their members, into the language of that country. Up-to-date forms and general information are always posted on the EABP website. No EABP copyright fees or conditions apply to EABP NAs. A copy of the translated material should be sent to the EABP Secretariat.
4.7 EABP is not responsible for the general activities of the NA in its own country, neither for any debts it may occur, nor for any contracts that it may be involved in, other than the specific clauses mentioned here or any specific additions to this agreement. Similarly the NA is not responsible for any activities or debts of EABP.
5. ETHICAL ISSUES
It is herein agreed that:
5.1 Ethical complaints about EABP members who are also members of the NA are usually forwarded directly to the EABP Ethics Committee Chairperson, or to the EABP General Secretary, and are dealt with according to the EABP Ethics Complaints Procedures. The NA can be asked to appoint people to assist the EABP Ethics Committee with facilitation and mediation in complaints about members in that country, however these NA appointees will not help to decide any particular ethics case.
5.2 If EABP NA’s wish to set up their own Ethics Committees to hear ethical cases against their members for national, formal, legal or other reasons, this needs a specific agreement with the EABP Ethics Committee. In this case all ethical complaints against EABP members would be dealt with in that country according to the EABP Ethics Complaints Procedures.
5.3 If the NA is dealing with a complaint through their own Ethics Committee, they should keep the EABP Ethics Committee Chairperson informed about the process of the complaint and must inform the EABP Ethics Committee Chairperson of the results of any decision about the complaint. The Ethics Committee of the NA may consult with the EABP Ethics Committee Chairperson, or another nominated person, at any time.
5.4 An EABP Member has the right to demand that a complaint against them is heard by the EABP Ethics Committee, rather than by the Ethics Committee of their NA. If the complaint is heard by the Ethics Committee of the NA, there is a right of appeal to the EABP Ethics Committee. Such an appeal cannot be against the decision or the outcome, but only on the grounds that the process of hearing the complaint was not in accordance with the EABP Ethics Complaints Procedures.
6. MODIFICATIONS TO THIS AGREEMENT
It is herein agreed that:
6.1 This agreement has been ratified by the EABP General Assembly and a General Meeting of the NA. Substantive changes to this agreement would have to be similarly ratified.
6.2 Refinements and specific details of this agreement that apply to any one NA must first be worked out by the COUNCIL, then approved by the EABP Board and the Board of the NA, and then final ratification may be needed from the General Assembly or Meeting of the EABP and the NA.
6.3 When differences or difficulties arise between the EABP Board and the NA and when they cannot be easily or satisfactorily resolved, these must be brought to the attention of the COUNCIL for resolution. The NA concerned and/or the EABP Board must accept any decision of the COUNCIL about the outcome of such a difficulty as binding.
6.4 If the EABP Board, after consultation with the COUNCIL, votes by a majority to end this agreement and, if this is ratified by a majority vote at a General Assembly of EABP, this agreement ceases. In such an instance, all membership records and any money due to EABP must be returned immediately to EABP Board and the NA must either dissolve itself or re-constitute itself separating all links from EABP. In such an event, individuals would still retain their rights to EABP Membership.
6.5 If a General Meeting of the NA decides to revoke this agreement, then all EABP Membership records and any money due to EABP must be returned immediately to the EABP Secretariat and the NA must cease to claim any association or link with EABP and change its statutes and name accordingly. In such an event, individuals would still retain their rights to EABP Membership.
6.6 In case of any misunderstandings due to translations, this contract is in English and should be read as such. In the case of any conflicts or disagreements about the content of this agreement that cannot be resolved between the representatives of the two parties, a mutually agreeable arbitrator must be found and that person’s decision will be taken as binding.
6.7 This Agreement replaces any previous signed agreement and any previous agreement remains valid until this agreement is signed.
